SleekTeak 10 YEAR WARRANTY

DECKadence Marine DBA SleekTEAK/SleekTEAK LLC hereby warrants to the original purchaser the SleekTEAK product sold by an authorized dealer or distributor, to be free from defects in material, for 10 years from the date of installation, when installed on gelcoat fiberglass boat decks or other approved applications. Our obligation under this warranty shall be limited to the repair or replacement of any part or parts of the material which may thus prove defective under normal recreational marine use within 10 years from the date of installation by the original purchaser or an authorized installer, and which our examination shall disclose to our satisfaction to be thus defective. Seller shall not be liable for normal manufacturing or natural irregularities nor for customary variations from specifications. Claims made for fade, adhesive backing defects, delamination of surface, refraction or change of color of installed material shall be limited to 7 years and may exclude any stains caused by organic or synthetic materials pending evaluation. Claims on finished merchandise must be made in writing. Seller shall not be liable for removal or installation costs.

THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR USE AND OF ALL OTHER OBLIGATIONS OR LIABILITIES ON OUR PART, AND WE NEITHER ASSUME, NOR AUTHORIZE ANY OTHER PERSON TO ASSUME FOR US, ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OF SLEEKTEAK DECK COVERING. THIS WARRANTY SHALL NOT APPLY TO THIS FLOORING MATERIAL OR ANY PART THEREOF WHICH HAS BEEN SUBJECT TO ACCIDENT, NEGLIGENCE, ALTERATION, ABUSE, OR MISUSE. WE MAKE NO WARRANTY WHATSOEVER IN RESPECT TO ACCESSORIES OR PARTS NOT SUPPLIED BY US. THE TERM “ORIGINAL PURCHASER,” AS USED IN THIS WARRANTY, SHALL BE DEEMED TO MEAN THAT PERSON FOR WHOM THE FLOORING IS ORIGINALLY INSTALLED. THIS WARRANTY SHALL APPLY ONLY WITHIN THE BOUNDARIES OF THE CONTINENTAL UNITED STATES.

Some states/provinces do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of special, incidental, or consequential damages, so these limitations and exclusions may not apply to you. This warranty gives you specific legal rights. You may also have other rights which vary from state/province to state/province.

This Limited Warranty (“Warranty”) is provided by DECKadence Marine DBA SleekTEAK, a Nevada corporation, in connection with the purchase of a DECKadence Marine DBA SleekTEAK product (“Covered Product”). This Warranty constitutes the entire agreement between DECKadence Marine DBA SleekTEAK and the Buyer concerning any warranty provided on the Covered Product.

DECKadence Marine DBA SleekTEAK warrants to the Buyer, defined as the first purchaser of the Covered Product (OEM, Certified Fabricator/Installer, authorized dealer/retailer, or end user), that the Covered Product is free from defects in workmanship and materials at the time of manufacture and for 10 years from the date the product is shipped to the Buyer. This Limited Warranty is subject to the condition that the Covered Product is used and maintained per DECKadence Marine DBA SleekTEAK’s specifications for preparation, installation, storage, and cleaning.

Warranty Coverage:

What is Covered:

Surface Pits: Small holes in the material present from the supplier of raw materials.
Delamination: Separation of PVC layers.
Damage from Production: Damage caused during the manufacturing process.
Production Errors: Mistakes or issues during production.
CAD Errors: Errors from the initial drawing or nesting of the product (if approved by the customer, not covered).
Logistics Errors: Shipping errors, lost shipments, or carrier damage.
Excessive Fading: Premature and/or excessive color lightening beyond normal fading.
Material Degradation: Deterioration due to excessive environmental exposure.
Color Bleeding: Dye extraction when wet.
Color Variance on Original Order Only: Variance of plus or minus 50% from the intended color.

What is Not Covered:

Workmanship/Adhesion Issues: Application or installation to the surface.
Wear and Tear: Normal loss, injury, or stress from use.
Stains: Marks from external sources.
Second Purchasers: Not the original order purchaser, nontransferable.
Cut or Altered Parts: Alterations made by the Buyer.
Third-Party Purchasers: Purchasers not directly from DECKadence Marine DBA SleekTEAK.

Covered products deemed defective within thirty-six (36) months of shipment will be replaced or refunded at DECKadence Marine DBA SleekTEAK’s discretion. Shipping charges for replacements within the U.S. may be covered; international shipping charges are the Buyer’s responsibility.

Warranty Claim Process:

To submit a warranty claim, request the warranty request form at info@sleekTEAK.com. Include photos of the defect. Claims must be submitted by the original purchaser; otherwise, they will be denied. OEM, Dealer, or Certified Networks must submit claims on behalf of end-user customers. The DECKadence Marine DBA SleekTEAK warranty team will review claims.

Limitations and Disclaimers:

DECKadence Marine DBA SleekTEAK’s liability under this Warranty is limited to the replacement value of the Covered Product. DECKadence Marine DBA SleekTEAK is not liable for consequential or indirect damages.

This Warranty cannot be transferred without prior written approval from DECKadence Marine DBA SleekTEAK. It is governed by Florida law, with jurisdiction in Brevard County, Florida, or the Federal Court for the Middle District of Florida, Orlando Division.

This Warranty supersedes any previous warranties. DECKadence Marine DBA SleekTEAK disclaims all other warranties, express or implied. No agent or representative can bind DECKadence Marine DBA SleekTEAK to any affirmation or warranty not included in this document.

By purchasing a DECKadence Marine DBA SleekTEAK product, the Buyer agrees to the terms of this Warranty.
